IF I RECEIVE AN INHERITANCE, CAN IT BE TAKEN TO PAY OFF MY RESTITUTION?

Yes. Under California Probate Code Sections 216 and 9202, estate attorneys, beneficiaries, and personal representatives are required to inform the California Victim Compensation Board (VCB) when a deceased person has an heir who was or is currently incarcerated within 90 days of the person’s death. To comply with these code sections, you must complete the Inmate Inheritance Notification Form (see Appendix A on PG. 684) and mail it to the address listed on the form. Once this form has been received by the VCB, the VCB has four months to pursue collection of any outstanding fines or orders.[2282]
