I am a tribal member receiving per capita payments from government settlement funds. Will this impact my eligibility for SSI?

No. Per capita payments paid to tribal members under settlement agreements are not taken into account for either SSI or Medicare part D purposes. So, for example, funds distributed per capita for members of the Hoopa Valley Indian Tribe and the Yurok Indian Tribe are excluded from income and resources for SSI eligibility. However, even though these funds should not be counted as income or a resource, the funds must still be reported.[3407]

Please note: It is very important to keep updated addresses on file with your Tribal enrollment office for any issues that may arise with per capita distributions.
